Trusts & Estates

When creating a plan to protect your assets, timely and proactive solutions in the design, drafting and implementation of complex wills, trusts, family partnerships and all significant personal planning entities are invaluable. Stark & Stark’s Trusts & Estates group offers assistance in tax counseling, forming and operating charitable entities, wealth preservation and protection, estate and trust administration, dispute resolution and business structuring.

The goal of every estate plan is to preserve and protect your families’ assets and well-being before a crisis occurs. Our attorneys advise professionals and families concerned about personal liability issues and assist them in the implementation of asset protection techniques.

Our team of estate planning attorneys have extensive experience in developing and executing unique strategies to ensure your financial, business and personal responsibilities are met before they lead to increased costs and difficulties. Our lawyers counsel individuals on how to accomplish their goals and objectives while minimizing the impact of federal, state, and local taxes and the technical difficulties that may arise during the probate of estate and trusts matters.

Our attorneys have had continued success in representing clients in asset protection and wealth preservation issues and have successfully represented clients in substantial will contests. Our substantial experience in both Federal and State tax law, probate law, corporate law, business succession planning and elder law enable us to provide each client with the attention to detail needed to ensure creative problem-solving techniques are applied.

Experience

  • Recently represented an estate that owned two businesses in Bucks County, which required us to delay commercial lender from acting on the death default provision in loan documents until the businesses could be sold.  We additionally represented this estate in connection with an IRS Audit of the Federal Estate Tax Return that resulted in the return being accepted as filed.
  • Represented the owner of a nationally known business which operates across the United States in creating and maintaining a charitable foundation as part of estate plan to minimize federal estate taxes.
  • Represented a client in a Will contest before the Bucks County Orphans’ Court, where we successfully preserved his inheritance.  The decision was appealed to the Pennsylvania Superior Court, where we were successful in having the Orphans’ Court decision upheld.
